"Party", "Parties", or "Us", refers to both the Member and Ourselves, or either the Member or Ourselves. All terms refer to the offer, acceptance and consideration of the Member at KCL, and any payment necessay to undertake the process of additional features or of our assistance to the Member in the most appropriate manner, whether by formal letter of a specific request, or any other means, for the express purpose of meeting the Member's needs in respect of provision of KCL's stated services/features, in accordance with and subject to those services/features. No License or Warranty, express or implied, by KCL, Snivac LLC or otherwise, to any Intellectual Property Rights are granted herein. Any use of the above terminology or other words in the singular, plural, capitalization and/or he/she or they, are taken as interchangeable and therefore referring to the same.
We are committed to protecting your privacy. Authorized moderators within KCL on a need to know basis, have access to, and only use any information provided by the Member. We constantly review our systems and data to ensure the best possible service to the Member. The only private information required for membership is an email address, which shall never be posted publically or sold to any other parties. We only send notifications and mailings as you request and for Member activation.
We take every measure possible to ensure your data is protected, and as such, any information contained therein. Member records and writings within this site may be viewable by other parties but shall never be published by KCL or any of our moderators or administrators, without the expressed written permission of the Member, unless legally required to do so to the appropriate authorities. Members have the right to request sight of, and copies of any and all records we keep in regards to their specific membership, on the provison that we are given reasonable notice and financial compensation of such a request. Members are requested to retain copies of any work they create here which may cause pain and/or suffering should that work be lost, KCL shall not be held responsible for such loss.
We will not sell, share, or rent your personal information to any third party or use your email address for unsolicited mail. Any emails sent by KCL will only be in connection with activation any and all notifications requested by the Member and in connection with the provisions of agreed services, products and features.

The above exclusions and limitations apply to the extent permitted by law. None of your statutory rights as a consumer are affected. As a member you will be responsible for the content you create here and the damages that may be caused inculding but not limited to: slander, liable, emotional distress, cyber bullying, solicitation and/or any criminal act against other members or any third parties.
KCL accepts payment by paypal which also accepts debit cards, personal electronic checks and all major credit cards. Payments are collected for pro access which grants additional features and content access on the website, services and products. Our Terms are payment in advance of all features, services and/or products. All services and features remain the property of KCL, as do the rights to create/duplicate/modify/use/sell those services and features, the Member is only granted access to use such Intellectual Propety Rights to an extent which does not grant the Member any financial gain, or KCL any loss. Mechandise and other products may be purchased and owned by the Member with all rights to use/sell/modify, but not duplicate for profit or for distribution. Any posting of advertisements or any content seen by KCL, it's moderators, or it's administrators as SPAM shall result in a payment due of $80USD. Our Terms on such are payment in full within thirty days. Monies that remain outstanding by the due date will incur late payment interest at the rate of 2% above the Federal Reserve base rate on the outstanding balance until such time as the balance is paid in full and final settlement. The interest shall compound daily, we reserve the right to seek recovery of any monies remaining unpaid ninety days form the date of invoice via collection agencies and/or through small claims court. In such circumstances, you shall be liable for any and all additional administrative and/or court costs.
You may cancel your membership at any time via the websites provided methods. Any outstanding balance on pro membership or other purchased services, features, and/or products will remain the posession of KCL and no refunds shall be issued. See Termination of Agreements and Refunds Policy below.
Both the Member and KCL have the right to terminate any Agreement for any reason, including the ending of features and services that are already underway. No refunds shall be offered, where a Service is deemed to have begun and is, for all intents and purposes, underway. Any monies that have been paid to us which constitute payment in respect of the provision of unused Services, shall be lost to the Member, with the following exception: Should a member terminate their own membership and return at a later date they may be allowed to resume any pro access which they have already purchased. It shall be the responsibility of the Member to provide receipt for pro access purchased, date at which membership was terminated and date at remaining duration of pro access. The re-instatement of the Member's pro access shall be on a case by case basis and is not guaranteed. Pro access is non-transferable.
Unless otherwise stated, the website and all services and features on the website are not guaranteed to be available at all times. We shall do everything within our ability to maintain and keep the website available, however, should circumstances outside our control arrise we make no assumptions that all data shall at all times be available. If for any reason the website is unavailable for a period greater than 72 consecutive hours the period of down time shall be applied to extend any expiration of pro access as purchased by the Member.
We use IP addresses to analise trends, adminster the site, track user's movement, gather broad demographic information for aggregate use and to protect the Members from malicious acts. IP addresses may be linked to the Members login, email address, display name, or other information provided. Additionally, for systems administration, detecting usage patterns and troubleshooting purposes, our web servers automatically log standard access information including browser type, access times, URL requested and referral. This information is not shared with other Members or any third parties, it is used only within KCL and Snivac LLC on a need-to-know basis. Any individually identifiable information related to this data will never be used in any way different to that stated above or within these Terms and Conditions, to include future edits, without your explicit permission.
Like most social networking websites KCL uses cookies to enable us to retrieve user details for each visit. Cookies are used within the site to enable functionality and display information which pertains to the Member. Cookies created for this purpose are deleted upon browser close unless you have asked the website to remember you upon your return.
